When we think of a Last Will and Testament, or simply a “Will” we often imagine something for the elderly or the ultra-rich. But under Philippine Civil Law, you don’t have to be older or wealthy to write a will. In fact, young professionals, freelancers, and even students with savings, investments, or sentimental items can benefit from preparing a Will.
Notarial Wills aren’t your only option
Many Filipinos think you need a notary public and witnesses to make a valid will. That’s true for notarial wills, but not for handwritten wills.
Article 810 of the Civil Code of the Philippines
A person may execute a holographic will which must be entirely written, dated, and signed by the hand of the testator himself. It is subject to no other form, and may be made in or out of the Philippines, and need not be witnessed.
This means a handwritten or holographic will is valid if:
It is entirely written, dated, and signed by you; and there are no witness is required in making and signing the Will. That means you can write your will in the comfort of your own home: no lawyer, no witnesses, no notarial fees. Two witnesses are only required during the probate of your will, but you don’t have to worry about that when making a will.
Why Young People Should Care
In this day and age, life is full of uncertainties. Accidents, health scares, or unexpected events can happen at any time, no matter how young or healthy you are. That’s why it’s wise to plan early and protect what matters to you.
Drafting your will today can help you:
- Protect your digital assetsFrom your online wallet balance to your crypto wallet or online store income, a handwritten Will ensures they go to the rightful heir, family member, friend, charity or even pet of your choice.
- Safeguard Your Sentimental ItemsYour vinyl collection, your books, or even your pet can be entrusted to someone you trust.
- Avoid family conflictsEven a short will makes your wishes clear, saving your loved ones from unnecessary disputes.
The making of a will is a strictly personal act.Article 784, Civil Code of the Philippines
This means you get to decide where your hard-earned savings or prized possessions go, not anyone else.
Writing a Last Will and Testament isn’t just for the older generation or the wealthy. It’s for anyone who wants to make sure their efforts and memories go to the right hands. Writing your handwritten will today is an empowering step towards securing your legacy, no matter your age.
